Jack Smith, the special counsel appointed by the Biden-Harris administration, filed a superseding indictment against former President Donald Trump on Tuesday, charging him with the same four counts Trump was previously charged with over his alleged role in the Capitol Hill protest on January 6, 2021.
The Post Millennial reported that a grand jury in Washington, D.C., returned the superseding indictment, which charges Trump with conspiracy to obstruct an official proceeding, conspiracy to defraud the United States, conspiracy against rights, and obstruction of and attempt to obstruct an official proceeding.
In a court filing, Smith’s office claimed that Tuesday’s superseding indictment “was presented to a new grand jury that had not previously heard evidence in this case” and “reflects the Government’s efforts to respect and implement the Supreme Court’s holdings and remand instructions in Trump v. United States.”
In July, the U.S. Supreme Court ruled that former presidents have immunity for official acts but not for unofficial acts. As a result, the Supreme Court sent Trump’s presidential immunity case back to the lower courts to determine whether Trump’s charges were related to official or unofficial acts.
In Tuesday’s indictment, prosecutors claimed, “The Defendant had no official responsibilities related to the certification proceeding, but he did have a personal interest as a candidate in being named the winner of the election.”

The Post Millennial reported that the new indictment removed a section of the original indictment that claimed Trump used the “power and authority of the Justice Department to conduct sham election crime investigations and to send a letter to the targeted states that falsely claimed that the Justice Department had identified significant concerns that may have impacted the election outcome.”
According to The Post Millennial, the change in Tuesday’s indictment followed the Supreme Court’s ruling that Trump was “absolutely immune from prosecution for the alleged conduct involving his discussions with Justice Department officials.”
Following the indictment, Trump released a statement on Truth Social, saying, “No Presidential Candidate, or Candidate for any Office, has ever had to put up with all of this Lawfare and Weaponization directly out of the Office of a Political Opponent.”
Trump claimed that the Biden-Harris administration has “weaponized” the U.S. justice system in an attempt to “interfere” with the 2024 presidential election.
“This is now Kamala’s [Harris’] Weaponized System against her Political Opponent,” Trump added. “All of these Scams will fail, just as Deranged Jack’s Hoax in Florida has been fully dismissed, and we will win the Most Important Election in the History of our Country on November 5th.”
